These terms of business form the basis upon which we provide our goods and services to potential clients and customers and upon which potential clients and customers may purchase and pay for our goods and services.

Intellectual property rights

Unless otherwise acknowledged by us, all proprietary and other intellectual property rights (including any copyright, trade mark, design right and database rights) in this website, belong to the author.  No part of this website is Public Domain, nor is any other image or content produced by Philip Curnow Photography whatsoever to be considered as public domain.  Unless specifically transferred for a consideration and a contract, copyright of all images and content produced by Philip Curnow Photography is copyright of Philip Curnow Photography and subject to the appropriate royalty payments.

 

For the avoidance of doubt, the author grants to you, a non-exclusive, royalty free licence to access this website from a single computer at any one time, subject to these terms of use for the sole purpose of viewing this website, but not to copy or download any part of this website.

 

Private Customers and Clients:

 Where members of the public may wish to purchase individual or bulk images by way of prints, downloads, disks or any other form of delivery, they may do so by ordering and paying for the items by Cash paid directly to Philip Curnow Photography,  Cheque made out to Philip Curnow Photography or by use of a Bank-Transfer, Credit or Debit card, paid through the website using the PayPal system.  Goods will be prepared when the order is received and acknowledged and dispatched when the funds are cleared in the bank account of Philip Curnow Photography.  Please do NOT send Cash in the post.

 

Where members of the public wish to contract for an Event Photography (Such as a Wedding, Christening or other similar event), there will be a requirement to pay a non-refundable booking fee in advance (normally at least a month in advance) with the balance payable after the event, when the actual photographs are ordered.   The minimum booking fee is £47.00 and larger booking fees will be required calculated at 50% of the estimated cost of the actual event photography cost.   The value of the booking fee paid will then be credited in full against the invoiced cost of photography and prints when the job is completed.

 

Where Philip Curnow Photography has provided an event photography service for a customer / client, images of the event will then be edited and placed upon a website for the customer / client / other interested party, to view and place their orders.   It is the responsibility of the customer / client to ensure that they have access to a suitable computer and link to view any images.  However, if requested beforehand, it is often possible for the images to be provided in copyright watermarked form on a disk after the event, where the customer / client  does not have access to a suitable computer.

 

 

“Trade and Business” Customers and Clients:

Where a Photographic, Video or other service is provided to Trade and Business customers, it may be provided on a credit account basis, with accounts becoming payable 30 days net after the date of the invoice.  The invoice shall be dated on the date which the specific service was first provided.  Payment for Trade and Business accounts may be paid by Cheque made out to Philip Curnow Photography or by BACS directly to the Bank Account of Philip Curnow Photography or by use of a Credit or Debit card, paid through the PayPal system.   Trade accounts are welcome and available automatically to all local and central government departments, recognised PLC businesses and most other commercial organisations subject to status.

 

VAT

VAT at the prevailing rate will be charged on all invoices to customers resident in the UK.    VAT is not charged to customers who are not resident in the UK and where the service is provided and delivered to a non UK address.

 

 

Jurisdiction and choice of law

These terms of business shall be governed by the laws of England and Wales and you shall submit to the exclusive jurisdiction of the Welsh courts.

 

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
